These Terms & Conditions govern the use of the DigiJen Studio website, client dashboard, marketplace and services.
1. About These Terms
DigiJen Studio operates from South Africa. These terms are governed by South African law, subject to applicable consumer protection and other mandatory legal requirements.
2. Services
DigiJen Studio offers branding, web design and development, digital marketing, social media management, CRM setup, business automation, videography, photography, drone production, in-person marketing and mobile vehicle advertising.
Each project is governed by the applicable written quotation, proposal or agreed brief. Work outside the agreed scope may be quoted separately before it begins.
Where a client selects a human-crafted, hybrid or AI-assisted delivery preference, we will follow the agreed approach. AI-assisted work is reviewed by our team before delivery.
3. Accounts
Users are responsible for keeping their login credentials secure and for activity under their accounts.
Account information must be accurate, and users must only use their assigned roles and permissions for their intended purposes.
We may suspend or close accounts involved in fraudulent, abusive or unlawful activity, subject to applicable law.
4. Quotes, Invoices and Payments
Unless otherwise stated, quotations remain valid for 14 days.
Invoices are issued through the client dashboard and are payable by EFT using the banking details on the invoice, unless another payment method is agreed in writing.
A deposit may be required before work begins. Retainers and subscription-style packages are generally billed in advance for the relevant period.
Clients should upload proof of payment against the relevant invoice where this functionality is provided.
Work may be paused where payment is overdue, subject to the applicable agreement and law.
Paid consultations are payable in advance. Once a session has taken place, the fee is non-refundable, subject to applicable law. Rescheduling requests should be made at least 24 hours in advance.
5. Client Responsibilities
Clients agree to provide the information, content, brand assets, access and feedback reasonably required to complete their projects.
Delays in providing materials or approvals may affect agreed delivery timelines.
Clients confirm that they have the necessary rights and permissions to provide any logos, images, text, footage or other materials supplied for use in a project.
6. Revisions, Cancellation and Refunds
The number of included revision rounds will be stated in the applicable quotation or agreement. Additional revisions may incur extra charges.
Clients may request project cancellation in writing. Charges may apply for work already completed and non-recoverable third-party costs, subject to applicable law and the agreed terms.
Deposits may be non-refundable once production has begun, to the extent permitted by law.
Videography, photography and drone bookings cancelled less than 48 hours before the scheduled date may be subject to cancellation charges where these have been agreed and are legally enforceable.
7. Vehicle Advertising and In-Person Campaigns
Vehicle advertising availability is subject to participating partners, coverage areas, campaign requirements and acceptance of the booking.
Coverage shown on the website is indicative and may change.
Audience reach, impressions, exposure figures and lead estimates are projections rather than guarantees of commercial results.
Drone services are subject to applicable South African aviation regulations, permissions, site access, weather and safety conditions.
8. Marketplace and Freelancers
The marketplace connects clients with independent freelancers.
Freelancers are not employees of DigiJen Studio merely because they use the marketplace. Unless DigiJen Studio expressly agrees in writing to manage a particular project, the relevant service agreement is between the client and freelancer.
Users must not submit misleading listings, spam, unlawful material or content that infringes third-party rights.
9. Intellectual Property
Subject to the applicable quotation or agreement, ownership of final approved deliverables transfers to the client once all amounts due for the relevant work have been paid in full.
DigiJen Studio retains ownership of its pre-existing tools, templates, workflows, automation systems, reusable components and unused concepts.
Completed work may be displayed in DigiJen Studio's portfolio and marketing materials unless the client requests otherwise in writing, subject to applicable confidentiality and privacy obligations.
10. Liability
DigiJen Studio will provide services with reasonable care and skill.
We do not guarantee specific commercial results, including sales, rankings, reach, impressions or leads.
Any limitations of liability must operate only to the extent permitted by applicable law and must not exclude rights or liabilities that cannot legally be excluded.
DigiJen Studio is not responsible for third-party platform outages or changes outside its reasonable control, subject to applicable law.
11. Changes to These Terms
We may update these terms from time to time. Updated terms will be published on this page, with an effective date where appropriate.
Changes to existing client agreements will be handled in accordance with the applicable agreement and law.
